By accessing or using the SixOrbit ERP platform and related services ("Services") provided by Accrete Globus Technology Pvt Ltd ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Services.

2. Description of Services

SixOrbit provides cloud-based Enterprise Resource Planning (ERP) software solutions including but not limited to:

• Sales and CRM management
• Inventory and warehouse management
• Financial accounting and GST compliance
• Production and manufacturing management
• Human resource management
• Business intelligence and analytics

3. Account Registration

To use our Services, you must:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Be responsible for all activities under your account

You must be at least 18 years old and have the legal authority to bind your organization to these Terms.

4. Subscription and Payment

Subscription Plans

Our Services are offered on a subscription basis. The specific features, limitations, and pricing are described in your subscription agreement or on our pricing page.

Payment Terms

• Fees are due as specified in your subscription agreement
• All fees are non-refundable unless otherwise stated
• We may change pricing with 30 days' notice
• Late payments may result in service suspension

Taxes

You are responsible for all applicable taxes (including GST) unless you provide valid exemption documentation.

5. Acceptable Use

You agree not to:

• Use the Services for any unlawful purpose
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the Services
• Upload malicious code or content
• Resell or redistribute the Services without authorization
• Use the Services to store or transmit infringing content
• Violate any applicable laws or regulations

6. Data and Privacy

Your Data

You retain ownership of all data you upload to the Services ("Your Data"). You grant us a license to use Your Data solely to provide the Services.

Data Processing

We process Your Data in accordance with our Privacy Policy and applicable data protection laws. For enterprise customers, we offer Data Processing Agreements upon request.

Data Backup

While we maintain regular backups, you are responsible for maintaining your own backup copies of critical data.

7. Intellectual Property

Our IP

The Services, including all software, content, and trademarks, are owned by Accrete Globus Technology Pvt Ltd or our licensors. These Terms do not grant you any rights to our intellectual property.

Feedback

If you provide feedback or suggestions, we may use them without any obligation to you.

8. Service Level

We strive to maintain 99.9% uptime for our Services. Service level commitments are detailed in our Service Level Agreement (SLA), available to enterprise customers.

9. Support

Support is provided based on your subscription plan. Standard support includes email and ticket-based assistance during business hours. Premium support options are available for additional fees.

10. Warranties and Disclaimers

THE SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY SHALL NOT EXCEED THE FEES PAID BY YOU IN THE 12 MONTHS PRECEDING THE CLAIM. WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES.

12. Indemnification

You agree to indemnify and hold us harmless from any claims arising from your use of the Services, your violation of these Terms, or your violation of any rights of a third party.

13. Termination

By You

You may terminate your subscription at any time by providing written notice. No refunds will be provided for unused portions of prepaid fees.

By Us

We may suspend or terminate your access if you breach these Terms, fail to pay fees, or if required by law.

Effect of Termination

Upon termination, your right to use the Services ceases. You may export Your Data for 30 days after termination, after which it may be deleted.

14. Governing Law

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Delhi, India.

15. Changes to Terms

We may modify these Terms at any time. We will provide notice of material changes. Continued use of the Services after changes constitutes acceptance of the new Terms.

16. General Provisions

• Entire Agreement: These Terms constitute the entire agreement between you and us.
• Severability: If any provision is found unenforceable, the remaining provisions remain in effect.
• Waiver: Failure to enforce any right does not constitute a waiver.
• Assignment: You may not assign these Terms without our consent.
